Inspiration Cruises – Terms & Conditions

These Terms and Conditions apply to all charters booked with Inspiration Cruises, operated by Gisbro Pty Ltd (ABN 99158703569). By confirming a booking or making payment, you agree to the following terms.

1. Bookings, Deposits & Payments

  • A $500 deposit (or full payment) is required to secure your booking. This deposit is strictly non-refundable.
  • The remaining balance is due no later than 14 days before your cruise date.
  • Failure to pay the balance by this date may result in cancellation of your booking and forfeiture of all monies paid.
  • Accepted payment methods: bank transfer or credit/debit card (surcharges may apply).

2. Cancellations & Rescheduling

  • All payments made to secure or confirm a booking are strictly non-refundable, regardless of the amount paid or notice period given prior to the charter date.
  • If you cancel, reschedule, or reduce your booking for any reason, all monies paid will be forfeited. Inspiration Cruises may, at its sole discretion, offer to reschedule the charter or apply the funds as a credit toward a future cruise, subject to availability.
  • No-shows or cancellations on the day will result in 100% forfeiture of all payments.
  • If Inspiration Cruises must cancel a charter due to unsafe weather, mechanical issues, or other operational reasons, guests will be offered either a full refund or a rescheduled date.

Travel Insurance: We strongly recommend that all guests—especially interstate and international visitors—obtain travel insurance to cover unforeseen changes of plans.

3. Weather & Safety

  • Cruises proceed in most weather conditions, including light rain and overcast skies. Refunds are not issued for weather unless the skipper deems it unsafe to operate.
  • In the rare event of cancellation due to unsafe conditions (e.g. high winds or storms), you will be offered a reschedule or full refund.
  • The decision to cancel due to weather is made by the skipper only and is final. We do not cancel for forecasted rain alone.
  • All charters are conducted within sheltered inland waterways — not open ocean.
  • All guests must follow crew safety instructions at all times. Failure to do so may result in early termination of the charter with no refund.
  • Decks may be slippery when wet; please take care and use handrails when moving around the vessel.

4. Responsible Behaviour Onboard

  • BYO alcohol and food are permitted; responsible behaviour is expected at all times.
  • No illegal substances are permitted. Serious misconduct, aggression, or damage to property will result in immediate termination of the charter without refund.
  • The booking party is responsible for ensuring all guests behave respectfully and follow the crew’s instructions at all times.

5. Bond & Damage

  • A security bond may be required depending on the nature of your charter or group size.
  • The booking party is fully responsible for any damage, breakage, theft, or loss caused by any guest, whether accidental or due to negligence, intoxication, or misconduct.
  • Repair or replacement costs will be charged at the full commercial rate, including labour, materials, or contractor fees.
  • If the vessel is rendered unavailable for future bookings due to damage or cleaning requirements, the booking party is liable for the loss of charter income during that period.
  • A minimum $500 cleaning fee applies if bodily fluids, excessive mess, or damage to carpet, upholstery, or bedding occurs.
  • Any unpaid repair or cleaning costs will be invoiced and must be paid within 7 days of notice. Failure to do so may result in recovery or legal action.

6. Guest List & Capacity

  • Maximum guest capacity: 25 passengers (plus crew).
  • Final guest numbers are due at least 48 hours prior to departure.
  • Additional guests beyond the confirmed number may not be permitted onboard due to safety and compliance limits.

7. Pickup, Departure & Timing

  • Main departure point: Appel Park Public Pontoon, 34 Cavill Avenue, Surfers Paradise QLD 4217 (unless otherwise arranged).
  • Please arrive 10–15 minutes before your scheduled departure time to ensure smooth boarding.
  • Your charter will begin and finish at the agreed times regardless of actual boarding time. Late arrival may reduce total cruising duration.
  • Alternative pickup or drop-off locations (e.g. Southport, Runaway Bay, Sanctuary Cove) may be arranged by prior agreement and may incur a travel or docking surcharge.
  • Inspiration Cruises reserves the right to make minor adjustments to departure times or locations due to factors beyond our control (e.g. marina works, tidal restrictions, public pontoon access). Guests will be notified where possible and every effort will be made to minimise disruption.

8. Liability & Risk

  • All guests board, cruise, and participate in onboard or water activities entirely at their own risk.
  • Gisbro Pty Ltd trading as Inspiration Cruises accepts no liability for injury, loss, or damage to guests or personal property, howsoever caused, including accident, negligence, or otherwise.
  • Guests are responsible for their own safety and must follow all crew instructions. Use handrails when moving around the vessel, especially in wet or windy conditions.
  • To protect the vessel, all guests must remove shoes upon boarding. No high heels or black-soled shoes are permitted. Guests may bring clean, non-marking deck shoes or grip socks if preferred.
  • Guests acknowledge that decks may be slippery when wet and agree to take reasonable care to prevent slips or falls. By boarding, guests waive any claim against the operator for injury or loss arising from such incidents.
  • Inspiration Cruises is not responsible for any personal property left onboard after the cruise. Items unclaimed after 48 hours may be disposed of.

9. Swimming & Water Activities

  • Swimming is only permitted with the captain’s approval, based on location, weather, and guest condition.
  • All swimming and water activities are entirely at guests’ own risk.
  • Life jackets are available upon request and may be required at the captain’s discretion.

10. Photography & Promotion

  • Guests are welcome to take personal photos and videos onboard.
  • Inspiration Cruises may take promotional photos or short clips during charters. Please advise the crew before departure if you prefer not to be included.

11. Privacy

  • All contact details provided are used strictly for booking, communication, and safety purposes.
  • Your information will never be shared with third parties without consent.

12. Third-Party Bookings

If your cruise was booked through an agency or online platform, these Terms & Conditions still apply in full. By boarding the vessel, you accept these terms regardless of booking method.

13. Indemnity

The booking party agrees to indemnify and hold harmless Gisbro Pty Ltd, its owners, employees, and contractors from any claims, damages, losses, or expenses (including legal fees) arising from the acts, omissions, or negligence of any guest within their group.

14. Agreement

By paying your deposit or any portion of the charter fee, you confirm that you accept these Terms & Conditions and that all guests in your party have been made aware of their responsibilities while onboard. Inspiration Cruises reserves the right to update these terms at any time without prior notice.
